GTC Singapura Cattery: Welcome to the Singapura Cattery “von Baden”. Here you will find the GTC Singapura Cattery of von Baden, which apply to all our contracts. The GTC Singapura Cattery of von Baden create clarity and trust for anyone who wants to buy a Singapura kitten. We, Kalpana and Rico, run our cattery as passionate hobby breeders committed to ethical cat breeding and the welfare of our animals. Our Singapura cat is known as the world’s smallest cat breed, and we are proud to place healthy, well-socialized kittens in responsible hands. Our cattery is of course FIFe registered.
These GTC Singapura Cattery govern the contractual relationship between us, the Singapura Cattery “von Baden”, and you as the buyer of our kittens. The GTC Singapura Cattery serve to provide clarity and transparency for all interested parties who wish to buy a Singapura kitten. Please read the GTC Singapura Cattery carefully. By concluding a purchase contract, you acknowledge the GTC Singapura Cattery of von Baden as binding. The GTC Singapura Cattery apply to all contracts for the sale of cats (hereinafter “kittens”) of the Singapura Cattery “von Baden”, Kalpana Gurung Anderer & Rico Anderer, Ettlinger Str. 22, 76337 Waldbronn, Germany (hereinafter “Seller”).
§ 1 Scope & partners
- These General Terms and Conditions – GTC Singapura Cattery – (hereinafter “GTC”) apply to all contracts for the sale of cats (hereinafter “kittens”) of the Singapura Cattery “von Baden”, Kalpana Gurung Anderer & Rico Anderer, Ettlinger Str. 22, 76337 Waldbronn, Germany (hereinafter “Seller”).
The Seller is a private hobby breeder and does not act as an entrepreneur within the meaning of § 14 BGB. The offers are exclusively directed at private end customers (consumers within the meaning of § 13 BGB). - Deviating or supplementary conditions of the buyer shall not become part of the contract unless their validity is expressly agreed to in writing.
§ 2 Subject & philosophy
- The subject matter of the contract is the sale of one or more kittens of the Singapura breed. The exact description of the respective kitten (name, sex, date of birth, color, chip number, pedigree number) shall be recorded in the individual purchase contract.
- All our kittens are placed as companion animals. Our breeding philosophy emphasizes species-appropriate husbandry and socialization. We are a FIFe registered cattery and place the greatest value on the health and well-being of our animals.
- Kittens are never placed alone. Preference is given to the sale of siblings or – when placing individual kittens – households with existing Singapura cats. Exceptionally, placement in households with other, demonstrably compatible cat breeds is conceivable.
- The kittens are given exclusively into pure, secure indoor housing. This also includes keeping them on secured balconies or terraces, provided they are designed to be cat-safe. Outdoor access is excluded.
§ 3 Reservation & contract
- Interested parties can contact us via our website singapura.de Contact and express their interest in a Singapura kitten. This does not yet constitute a binding reservation or a purchase contract.
- After a detailed exchange and a personal selection by the Seller, a binding reservation of a kitten can be made.
- A deposit of 50% of the purchase price must be paid for this purpose. The reservation only becomes effective upon receipt of the deposit into the Seller’s account.
- The actual purchase contract is concluded exclusively in person upon collection of the kitten on the Seller’s premises in Waldbronn. At this time, a written purchase contract will be signed.
- Since the purchase contract is concluded in person and not through distance selling, you as the buyer have no statutory right of withdrawal. You have the opportunity to inspect the kitten in person on site and convince yourself of its condition.
§ 4 Prices & payment
- The purchase price for a companion animal is set in a binding reservation agreement.
- Upon reservation, a deposit of 50% of the purchase price is due.
- The remaining payment of the purchase price and the costs for early neutering are to be paid in cash no later than upon handover of the kitten.
- If a reserved kitten is not accepted for reasons for which you are responsible (e.g., withdrawal from the reservation without good cause), the deposit shall be forfeited as a flat-rate reimbursement of expenses for the costs incurred and the lost sale.
§ 5 Handover & risk
- The kittens are handed over at the earliest at the age of 14 weeks to ensure optimal socialization. The Seller reserves the right to postpone the handover to a later date if necessary.
- The handover of the kitten takes place in person on the Seller’s premises.
- At the time of handover, the kittens are vaccinated (against feline panleukopenia and feline viral rhinotracheitis, as well as rabies only upon request), dewormed, microchipped, and early-neutered. A veterinary health certificate and the pedigree will be handed over to you upon handover.
- Upon handover of the kitten, the risk of accidental loss and accidental deterioration passes to you.
§ 6 Warranty & liability
- The Seller warrants that the kitten is free from material defects at the time of handover that would cancel or diminish its value or its suitability for ordinary use as a companion animal. The kittens are handed over with a veterinary health certificate.
- For defects that occur after handover, the Seller is liable in accordance with the statutory provisions of purchase law. You are obligated to notify obvious defects immediately after handover.
- A general exclusion of reimbursement of veterinary costs in the event of a defect is ineffective under case law, as the animal welfare principle (Art. 20a GG) does not limit the appropriateness of veterinary treatment by the economic value of the animal.
- If a defect exists that requires veterinary treatment, the costs for necessary and appropriate treatment shall be borne by the Seller, provided the defect already existed at the time of the transfer of risk. The appropriateness of the treatment costs is not limited by the purchase price of the animal.
- The Seller’s liability for slight negligence is excluded, unless material contractual obligations are violated or damage resulting from injury to life, limb, or health occurs.
§ 7 Use (companion animal)
- The purchased Singapura kitten is sold exclusively as a companion animal and is not intended for breeding purposes. This is ensured by early neutering before handover.
- If, contrary to the contractual provision and the early neutering, breeding is carried out with an animal acquired from us – intentionally or unintentionally – a surcharge of EUR 1,500.00 for a breeding animal shall become due. This amount is payable immediately after the Seller becomes aware of the breeding use.
- Should the foregoing clause on breeding use and the surcharge be invalid for legal reasons, the remaining provisions of these GTC and the purchase contract shall remain unaffected. We undertake in this case to agree on a valid provision that comes closest economically to the invalid provision.
§ 8 Data protection
- The processing of personal data is carried out in accordance with our privacy policy, which can be accessed on our website at Privacy Policy.
- We refer to the information provided there on the collection, processing, and use of your data within the framework of the GDPR and the BDSG.
§ 9 Final provisions
- For these “GTC Singapura Cattery”, the law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
- Should individual provisions of these GTC be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective that the contracting parties pursued with the invalid or unenforceable provision. This applies accordingly in the event that these GTC should contain a loophole.
- The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC and the purchase contract is, to the extent permitted by law, the seat of the Seller in Waldbronn.
